Shift Intelligence respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the information we may collect from you, or that you may provide, when you visit shiftintelligence.app (our "Site"), engage with us as a Client, or are contacted by our AI on behalf of a Client business, and describes our practices for collecting, using, maintaining, protecting, and disclosing that information. By accessing or using the Site, you agree to this Privacy Policy. This policy may change from time to time; continued use after changes are posted constitutes acceptance. "We," "us," and "our" mean Shift Intelligence. "You" and "your" mean the individual or business accessing the Site or interacting with our Services.

What Is Covered by This Policy

This policy covers information we collect through the Site and through any email, SMS, WhatsApp, or other electronic messages exchanged between you and Shift Intelligence or our AI systems acting on behalf of a Client.

What Information Do We Collect?

We collect several types of information from and about users of our Site and Services, including information that personally identifies you, such as name, business name, email address, and telephone number ("personal information"), as well as information about the equipment and connection used to access our Site and Services. We collect this directly from you when you provide it, and automatically as you interact with our Site or as our AI engages in conversation on a Client's behalf. Automatically collected information may include usage details, IP addresses, and cookie data. We retain records of correspondence, including emails, if you contact us.

Are Cookies or Other Technologies Used to Collect Information?

As you interact with our Site, we may use automatic data collection technologies to gather information about your equipment, browsing actions, and patterns, including traffic data and IP address, operating system, and browser type. This information helps us operate, secure, and improve the Site, and to recognize returning visitors.

How Do We Use Personal Information?

We use the information we collect to: present the Site and its contents to you; provide the Services requested by Client; fulfill the purpose for which the information was provided; send account and billing notices; enforce our rights and obligations under any agreement between us; notify you of changes to the Site or Services; and, with consent, contact Client about other services that may be of interest. If Client does not want to receive such communications, Client may opt out by contacting us at the email below.

Why May We Disclose Information?

We may disclose aggregated, non-identifying information without restriction. We may disclose personal information as described in this policy: to service providers and subprocessors who support our business and are contractually bound to keep it confidential and use it only for the purpose disclosed (including hosting providers, GoHighLevel, and Anthropic, whose Claude AI models we use to power conversational Services); to a buyer or successor in the event of a merger, acquisition, or sale of business assets; to comply with a court order, law, or legal process, including government or regulatory requests; to enforce these Terms or our Privacy Policy, including for billing purposes; and if we believe disclosure is necessary to protect the rights, property, or safety of Shift Intelligence, our clients, or others. We do not sell personal information to third parties.

How Is Personal Information Secured?

We implement measures designed to secure personal information from accidental loss and unauthorized access, use, alteration, or disclosure. The security of your information also depends on you — where you hold credentials for accessing any part of the Site or integrated systems, you are responsible for keeping them confidential. Transmission of information over the internet is never completely secure; we cannot guarantee the security of information transmitted to us, and any such transmission is at your own risk. We are not responsible for circumvention of any privacy or security measures on the Site.

Are Links Covered by This Policy?

The Site may contain links to third parties, including service providers and integration partners. These third parties may independently collect information about you through their own cookies or tracking technologies. We do not control third-party tracking technologies or their use; questions about a specific link should be directed to that provider.

How Can You Access, Change, or Delete Your Personal Information?

You may email us at [email protected] to request access to, correction of, or deletion of personal information you have provided to us. We may not accommodate a request if we believe it would violate any law, legal requirement, or cause the information to become incorrect. If you are a lead or customer of one of our Clients rather than a Client yourself, we may direct your request to the relevant Client, as they control the underlying business relationship. Applicable privacy laws in your jurisdiction (such as the GDPR or CCPA) may provide you with additional rights regarding your personal information.

AI and Third-Party Processing

Our Services use artificial intelligence, including large language models provided by Anthropic (Claude), and our primary CRM/automation platform is GoHighLevel, to conduct conversations, qualify leads, and schedule appointments on behalf of our Clients. Message content and related data may be transmitted to and processed by these providers solely to deliver the Services. We obtain Client's consent to this data sharing as part of onboarding, and Client may direct any of its own end-customers' opt-out requests to us at the email below. We do not use Client Data to train AI models for the benefit of any party other than the Client to whom the data relates, except as required for the underlying operation of third-party AI tools under their own data protection terms.

May Children Use the Site or Services?

Our Site and Services are intended for business use (B2B) and are not directed at children. We do not knowingly collect personal information from individuals under 18. If we learn we have inadvertently collected such information, we will delete it. If you believe we may have information from or about a child under 18, please contact us at the email below.

Data Retention

We retain information for as long as necessary to provide the Services, support the ongoing business relationship with Client, improve our Services, and comply with legal, accounting, or reporting obligations, including after termination of Services where a legitimate business or legal reason exists to continue holding it.

How Are Policy Changes Communicated?

We will post any changes to this Privacy Policy on this page, with an updated "Last modified" date, and will notify you of material changes through a notice on the Site. You are responsible for periodically reviewing this policy for updates.

International Data Transfers

We operate from the United States and may serve Clients internationally in the future. By using the Site or Services, you consent to having your information transferred to, stored, and processed in the United States and other countries where our service providers operate, which may have data protection laws different from those in your jurisdiction.
